Smoking Ban

The Salem Board of Health instituted a smoking ban in all restaurants, bar areas of restaurants and in bars,

beginning on April 1, 2001.

Many restaurant owners were worried that the ban would drive people to other restaurants in neighboring towns.

Marblehead and Swampscott both had smoking bans before Salem's.

When first proposed, city leaders knew it would end up in court. In Jan. of 2001, the Massachusetts Supreme Judicial Court

unanimously upheld the right for local health boards to impose such bans.
